LC Mike Smith Wins Major Claim

Local Chairman Mike Smith of Local Lodge 430 wins $30,625.38 for the Machinists he represents at the BNSF Havre Locomotive Shop in Montana.

 

BNSF Havre Montana Locomotive Shop is implementing a new system for tools and tracking of work don on locomotives.  This system is going to be implemented across the BNSF System.  This system includes the digitally checking out tools.  This new system created new positions, in which the Havre Montana Management hired Clerks to fill. This is not Clerks work.  This scope of work is not Clerks work by contract nor have the Clerks ever done this work before.  This work belongs exclusively to the Machinist by Contract and Machinist historically and exclusively always done this work. 


Local Lodge 430 Local Chairman Mike Smith acted and got with his General Chairman, John Denny and over next several months BNSF Havre Montana Locomotive Shop is implementing a new system for tools and tracking of work don on locomotives.  This system is going to be implemented across the BNSF System.  This system includes the digitally checking out tools.  This new system created new positions, in which the Havre Montana Management hired Clerks to fill. Local Lodge 430Local Chairman Mike Smith acted and got with his General Chairman, John Denny worked very hard together over the several months trying to convince the Havre Montana Managers that this was the exclusive work of the Machinist and not the work of the Clerks.  However, Havre Managers refused to cooperate and forced Brother Smith to file claims for the willful violation of our Contract.


Only after the claims were filed was the Carrier willing to sit down and negotiate a way to settle this dispute.  Local Smith in fact did reach a very favorable settlement totally in favor of the Machinist.  The Carrier agreed to create three new Machinist positions in the tool room and agreed to pay $30,625.88 to Machinist for assigning Machinists work to the Clerks.


Local Chairman Mike Smith work extremely hard and was successful in protecting Machinist work and getting them what was rightfully theirs, $30,625.38 of pay.


Thank you, Brother Smith for your dedication to the members you represent and protecting their work.  This claim settlement is a big victory in another way.  Now we have it in writing that BNSF recognizes that tool room work is the exclusive work of the Machinist's Craft on the BNSF Railroad.
